1. general provisions

1.1 These General Terms and Conditions (GTC) govern the contractual relationship between the ACTP SECURITY GROUP GMBH (hereinafter referred to as „ACTP“) and its customers. 1.2 Deviations from these GTC, supplements or ancillary agreements must be made in writing to be effective. 1.3 The currently valid GTC can be viewed on ACTP's website and will be made available to the customer on request.

2. subject matter of the contract

2.1 ACTP shall provide security and transport services as well as other contractually agreed services using trained and qualified personnel. 2.2 The services shall be performed in accordance with the applicable statutory provisions and in accordance with the contractually agreed conditions. 2.3 ACTP reserves the right to use subcontractors if this is necessary for the fulfilment of the contract.

3. start of service and location

3.1 ACTP employees shall always start work at the warehouse at Brandstrasse 24, 8952 Schlieren, if material, equipment or vehicles are required for the assignment (e.g. for transport services). 3.2 The collection, checking and loading of material in the warehouse is part of the working time. 3.3 The further place of deployment shall be specified in the contract in advance. Changes or additional requirements at the place of use must be communicated in good time.

4. working hours and break regulations

4.1. Limitation of working hours: Assignments may not last longer than 12 hours of pure working time for the employee deployed. In the case of longer assignments, realisation cannot be guaranteed. In such cases, ACTP is authorised to deploy additional personnel as an emergency measure, provided that capacities are available. The costs for the additional personnel deployment shall be invoiced in full to the customer. 4.2. Break regulation: The customer is obliged to inform ACTP in advance whether a break replacement is required. If no such information is provided, ACTP will organise a break replacement and charge the customer for the costs incurred.

5. minimum stake and billing of services

5.1 The minimum stake for each order is three (3) hours per employee. Shorter assignments will nevertheless be charged at a minimum of three hours. 5.2. Invoicing of all ordered hours: The customer undertakes to pay the full number of hours ordered in advance, regardless of whether the actual utilisation is shorter. 5.3. Surcharges:

  • On public holidays a surcharge of 25 % charged at the regular hourly rate.

  • For night and Sunday shifts, a surcharge of 10 % charged at the regular hourly rate. 5.4. Emergency flat rate: For urgent assignments at short notice, an emergency flat rate of up to CHF 250 depending on the urgency and availability of personnel. 5.5 Prices may be adjusted by ACTP at any time with reasonable advance notice.

6. cancellation conditions

6.1 For cancellations less than 48 hours before the start of the assignment, a lump sum of 50 % of the agreed daily rate will be charged. 6.2 For cancellations less than 24 hours If a cancellation is made before the start of the assignment, the full daily rate (100 %) will be charged. 6.3 Changes or cancellations must be submitted to ACTP in writing.

7 Obligations of the customer

7.1 The customer shall provide ACTP with all necessary information and documents in good time. 7.2 The customer shall ensure that the place of use is safe and complies with the statutory regulations. 7.3 Sources of danger or restrictions must be reported to ACTP immediately.

8 Liability and force majeure

8.1 ACTP shall only be liable for damage caused by intentional or grossly negligent behaviour on the part of its employees. Liability for simple negligence is excluded. 8.2. Force majeure: ACTP accepts no liability for the cancellation or delay of services due to events of force majeure (natural disasters, war, pandemics, strikes, etc.). In such cases, ACTP is authorised to suspend services without any obligation to pay compensation.

9. remuneration and terms of payment

9.1 Payment shall be made in accordance with the contract. All prices are net prices plus statutory VAT. 9.2 Invoices are payable within thirty (30) days from the invoice date without deduction. 9.3 In the event of late payment, ACTP may suspend the services or charge interest on arrears.

10. cancellation and termination of contract

10.1 The cancellation of orders must be made in writing. 10.2 Cancellation is possible free of charge up to 48 hours before the start (thereafter the conditions under point 6 apply). 10.3 The right to cancellation without notice for good cause remains unaffected.

11 Data protection and confidentiality

11.1 ACTP shall treat all information confidentially. 11.2 The customer has the right to information about his stored personal data at any time.

12. recording of calls

12.1 Telephone calls may be recorded to ensure quality and to preserve evidence. 12.2 By making contact, the caller agrees to the possible recording. 12.3 The recordings will be deleted after a reasonable period of time.

13. inspection of documents

13.1 The customer may request in writing to inspect deployment-related documents (deployment reports, plans). 13.2 If the inspection involves considerable costs, ACTP may charge a reasonable fee.

14. service regulations (ADV, BDV, KDV)

14.1 The scope of services is based on the General Service Regulations (ADV) of the ACTP. 14.2 Specific requirements are set out in Special service regulations (BDV) or at short notice in KDV specified. 14.3 Complaints regarding the execution must be made within 48 hours The regional head office must be notified in writing of any changes, otherwise the claim will be forfeited. 14.4 Verbal instructions at the place of work are not binding unless they have been confirmed in writing by ACTP.
